The Indian Overseas Congress USA has issued a sweeping condemnation of an FIR filed against Leader of the Opposition Rahul Gandhi, characterizing the criminal case as a weaponization of the justice system to suppress debate over caste discrimination. The organization called on authorities in Uttarakhand to maintain equal standards under the law and conduct an independent probe into an alleged “purification” ceremony held after a rally led by Congress President Mallikarjun Kharge.

NEW YORK — The Indian Overseas Congress USA (IOC USA) has forcefully condemned the registration of a First Information Report (FIR) against Leader of the Opposition in the Lok Sabha, Rahul Gandhi, terming the legal action a deliberate attempt to intimidate political figures who challenge systemic caste discrimination and untouchability.

The statement, issued by IOC USA President Mohinder Singh Gilzian, follows a high-profile legal dispute in Uttarakhand’s Haldwani town. Police there registered a criminal case against Gandhi following his public remarks criticizing an alleged “purification” ceremony (shuddhikaran yajna) performed at a public ground shortly after an August 8 political rally addressed by Congress National President Mallikarjun Kharge.

The Haldwani Dispute and Legal Escalation

The controversy traces back to August 8, 2026, when AICC President Mallikarjun Kharge addressed a major Congress party gathering at the Ramlila Ground in Haldwani. Three days later, on August 11, members of local right-wing groups, including the Shri Ram Sena Dharmarth Seva Nyas, gathered at the venue to conduct a havan and cleanliness drive.

Congress leaders immediately characterized the ritual as a “purification” ceremony aimed at a venue recently occupied by Kharge, a prominent Dalit political leader, labeling the act a clear manifestation of an anti-Dalit mindset and a violation of constitutional protections against untouchability. Representatives of the organizing groups and the ruling Bharatiya Janata Party (BJP) countered that the effort was purely a standard cleanup drive to restore a religious space after litter and inappropriate political slogans were left behind.

The dispute moved into a broader national spotlight on August 29, when Rahul Gandhi held a press conference in New Delhi. Pointing to the Haldwani incident, Gandhi demanded that police register a case under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against those who conducted the ceremony, describing the act as an unacceptable manifestation of caste prejudice.

In response, on August 30, Haldwani City Kotwali Police registered FIR No. 0297/2026 against Rahul Gandhi following a formal complaint by Amit Kumar, a resident of Jawahar Nagar and a member of the Valmiki community. Kumar alleged that Gandhi gave a false “casteist angle” to a routine sanitation drive in which members of the Scheduled Caste community had themselves participated, thereby insulting participants and promoting social enmity.

Uttarakhand police invoked multiple criminal provisions against the Leader of the Opposition:

  • BNS Section 196: Promoting enmity between different groups on grounds of religion, race, or caste.
  • BNS Section 299: Deliberate and malicious acts intended to outrage religious feelings.
  • SC/ST Act Provisions: Sections 3(1)(r) and 3(1)(u), alleging acts intended to insult or promote feelings of ill-will against members of Scheduled Castes.

Diaspora Leadership Reacts to Legal Action

Speaking from New York on behalf of the diaspora organization, Mohinder Singh Gilzian described the FIR against Gandhi as a dangerous precedent that shifts investigative focus away from alleged caste bias and onto those who question it.

“The FIR against Rahul Gandhi is deeply troubling and appears to be an attempt to intimidate those who speak against caste discrimination and untouchability,” Gilzian said. “Instead of investigating the circumstances surrounding the alleged purification ritual and addressing the concerns raised by the Congress leadership, the authorities have chosen to target the person who questioned it. This sends a disturbing message about the shrinking space for speaking against caste-based discrimination in India.”

Gilzian emphasized that the constitutional prohibition of untouchability under Article 17 forms a bedrock principle of Indian democracy that cannot be set aside for political advantage.

“India’s Constitution abolished untouchability and guarantees equality before the law,” Gilzian noted. “Any practice that humiliates a person because of their caste must be questioned, regardless of who is involved. Raising such concerns cannot itself become a criminal offence.”

The diaspora leader accused state authorities of applying a selective standard of law enforcement, arguing that the state’s legal machinery should be deployed to protect marginalized groups rather than to penalize political dissent.

“If an allegation of caste-based discrimination has been made, the appropriate response is an impartial investigation—not an FIR designed to silence the political opposition,” Gilzian added. “The law must apply equally to everyone. There cannot be one standard for those in power and another for those who challenge discrimination.”

Demands for Accountability and Constitutional Integrity

Extending full solidarity to Rahul Gandhi, Mallikarjun Kharge, and civil rights advocates across India, the IOC USA demanded complete transparency from the Uttarakhand state government and law enforcement institutions regarding how the complaint against Gandhi was evaluated and processed.

The organization urged Uttarakhand authorities to release the evidentiary basis upon which criminal charges were initiated against the Leader of the Opposition. Furthermore, the IOC USA called for a fully independent, transparent examination of the original August 11 event at the Ramlila Ground to determine whether discriminatory practices occurred.

“The Indian Constitution is the greatest safeguard against caste discrimination, untouchability and social exclusion,” Gilzian stated. “Those who raise their voice for equality should not be intimidated. Indian Overseas Congress USA stands firmly with the constitutional values of equality, dignity, fraternity and justice.”

Closing the statement, the organization warned against the growing normalization of legal mechanisms being used to suppress political commentary. “No government, police authority or public institution should be permitted to weaponize the law to intimidate political leaders or silence voices challenging caste-based discrimination,” the statement concluded. “We demand that the Uttarakhand government demonstrate that the law is being applied equally and without political influence.”
